Bu d\u00fczenlemelerden \u00f6nemlileri a\u015fa\u011f\u0131da yer almaktad\u0131r:<\/p>\n<ul>\n<li>5104 Say\u0131l\u0131 Kuzey Ankara Giri\u015fi Kentsel D\u00f6n\u00fc\u015f\u00fcm Projesi Kanunu (RG 12.03.2004<\/li>\n<li>5273 say\u0131l\u0131 Arsa Ofisi Kanunu ve Toplu Konut Kanununda ve Genel Kadro ve Usul\u00fc Hakk\u0131ndaki Kanunun Eki Cetvellerin Toplu Konut \u0130daresi Ba\u015fkanl\u0131\u011f\u0131na Ait B\u00f6l\u00fcm\u00fcnde De\u011fi\u015fiklik Yap\u0131lmas\u0131 Hakk\u0131nda Kanun (RG 12.05.2004)<\/li>\n<li>5216 Say\u0131l\u0131 B\u00fcy\u00fck\u015fehir Belediyelerinin Y\u00f6netimi Hakk\u0131ndaki Kanun H\u00fckm\u00fcnde Kararnamenin De\u011fi\u015ftirilerek Kabul\u00fc Hakk\u0131ndaki Kanun (RG 10.07.2004)<\/li>\n<li>5226 Say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu ve \u00c7e\u015fitli Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131 Hakk\u0131nda Kanun (RG 27.07.2004)<\/li>\n<li>5393 Say\u0131l\u0131 Belediye Kanunu (RG 13.07.2005)<\/li>\n<li>5366 Say\u0131l\u0131 Y\u0131pranan Tarihi ve K\u00fclt\u00fcrel Ta\u015f\u0131nmaz Varl\u0131klar\u0131n Yenilenerek Korunmas\u0131 ve Ya\u015fat\u0131larak Kullan\u0131lmas\u0131 Hakk\u0131nda Kanun (RG 05.07.2005)<\/li>\n<li>6306 Say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun (RG 31.05.2012)<\/li>\n<\/ul>\n<p>6306 Say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun ile afet riski alt\u0131ndaki alanlar ve bu alanlar d\u0131\u015f\u0131ndaki riskli yap\u0131lar\u0131n bulundu\u011fu arsa ve arazilerde, fen ve sanat, norm ve standartlar\u0131na uygun, sa\u011fl\u0131kl\u0131 ve g\u00fcvenli ya\u015fama \u00e7evrelerini te\u015fkil etmek \u00fczere iyile\u015ftirme, tasfiye ve yenileme \u00e7al\u0131\u015fmalar\u0131; ba\u015fta \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 olmak \u00fczere b\u00fcy\u00fck\u015fehir belediyeleri, TOK\u0130 ve yetki verilen di\u011fer belediyelerce de y\u00fcr\u00fct\u00fclebilmektedir. 6306 Say\u0131l\u0131 Kanun kapsam\u0131nda d\u00f6n\u00fc\u015f\u00fcm i\u015fini yapacak idare; belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde belediyeler, bu s\u0131n\u0131rlar d\u0131\u015f\u0131nda il \u00f6zel idareleri, b\u00fcy\u00fck\u015fehirlerde b\u00fcy\u00fck\u015fehir belediyeleri ve Bakanl\u0131k taraf\u0131ndan yetkilendirilmesi halinde b\u00fcy\u00fck\u015fehir belediyesi s\u0131n\u0131rlar\u0131 i\u00e7indeki il\u00e7e belediyeleridir.<\/p>\n<p>5393 Say\u0131l\u0131 Kanun kapsam\u0131nda, belediye meclisi karar\u0131yla; konut alanlar\u0131, sanayi alanlar\u0131, ticaret alanlar\u0131, teknoloji parklar\u0131, kamu hizmeti alanlar\u0131, rekreasyon alanlar\u0131 ve her t\u00fcrl\u00fc sosyal donat\u0131 alanlar\u0131 olu\u015fturmak, eskiyen kent k\u0131s\u0131mlar\u0131n\u0131 yeniden in\u015fa ve restore etmek, kentin tarihi ve k\u00fclt\u00fcrel dokusunu korumak veya deprem riskine kar\u015f\u0131 tedbirler almak amac\u0131yla kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim projelerini do\u011frudan belediye, belediye ile TOK\u0130 ve hatta \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131-belediye-TOK\u0130 i\u015fbirli\u011fi i\u00e7inde \u00e7al\u0131\u015farak geli\u015ftirilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>T\u00fcrkiye\u2019de yap\u0131lan kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131 gerek afet riski ta\u015f\u0131yan yap\u0131 ve alanlar\u0131n yeniden yap\u0131land\u0131r\u0131lmas\u0131, gerekse tarihi yap\u0131 ve alanlar\u0131n yenilenerek korunmas\u0131 amac\u0131yla ba\u015flat\u0131lm\u0131\u015f ve h\u0131zla devam etmektedir. Kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn t\u00fcm taraflar\u0131n\u0131n, yap\u0131lacak baz\u0131 yasal d\u00fczenlemelerin \u00e7al\u0131\u015fmalar\u0131 olumlu y\u00f6nde etkileyece\u011fi ortak kanaatleri bulunmaktad\u0131r. Buna g\u00f6re;<\/p>\n<ul>\n<li>6306 Say\u0131l\u0131 yasa kapsam\u0131na al\u0131nacak alanlar\u0131n; kadastral, imar vb. sorunlar\u0131n\u0131n giderildikten sonra ilan edilmesi,<\/li>\n<li>Kentsel D\u00f6n\u00fc\u015f\u00fcmde de\u011ferlemelerin SPK lisansl\u0131 \u015firketlere ve uzmanlara, uluslararas\u0131 de\u011ferleme standartlar\u0131na g\u00f6re yapt\u0131r\u0131lmas\u0131,<\/li>\n<li>Yasal olmayan yap\u0131lar\u0131n d\u00f6n\u00fc\u015f\u00fcme nas\u0131l kat\u0131laca\u011f\u0131n\u0131n belirlenmesi,<\/li>\n<li>Kentsel D\u00f6n\u00fc\u015f\u00fcm Projelerine finansal a\u00e7\u0131dan destek olacak mevzuat d\u00fczenlemelerinin yap\u0131lmas\u0131n\u0131n, 5393 Say\u0131l\u0131 Kanunun 73. Maddesinin uygulanmas\u0131na ili\u015fkin detaylar\u0131 i\u00e7eren kentsel d\u00f6n\u00fc\u015f\u00fcm projeleri uygulama y\u00f6netmeli\u011finin haz\u0131rlanmas\u0131,<\/li>\n<li>Kentsel D\u00f6n\u00fc\u015f\u00fcm Matematiksel Modelinin olu\u015fturulmas\u0131na y\u00f6nelik k\u0131lavuz olu\u015fturulmas\u0131 ve ilgili mevzuatlar i\u00e7erisinde yer verilmesi<\/li>\n<li>6306 Say\u0131l\u0131 Kanun kapsam\u0131nda yap\u0131lan riskli alan d\u00f6n\u00fc\u015f\u00fcm projelerinin etaplar halinde onaylanmas\u0131na y\u00f6nelik yasal d\u00fczenlemelerin yap\u0131lmas\u0131,<\/li>\n<li>Bakanl\u0131k deste\u011fi ve kontrol\u00fcnde t\u00fcm kentler i\u00e7in Kentsel D\u00f6n\u00fc\u015f\u00fcm Master Plan\u0131 haz\u0131rlanmas\u0131na ili\u015fkin yasal d\u00fczenlemelerin yap\u0131lmas\u0131 durumunda kentsel d\u00f6n\u00fc\u015f\u00fcm projelerine ili\u015fkin \u00e7al\u0131\u015fmalar\u0131n ve s\u00fcre\u00e7lerin olumlu y\u00f6nde etkilenece\u011fi d\u00fc\u015f\u00fcn\u00fclmektedir.<\/li>\n<\/ul>\n<p>Ayr\u0131ca hem alan bazl\u0131 kentsel d\u00f6n\u00fc\u015f\u00fcm modellemelerinde, hem de parsel bazl\u0131 kentsel d\u00f6n\u00fc\u015f\u00fcm \u00e7al\u0131\u015fmalar\u0131nda yanl\u0131\u015f belirlenmi\u015f arsa paylar\u0131 ciddi sorunlara sebep olmaktad\u0131r.
